What is the MGNREGA Act of 2005?
The Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA or NREGA) is an Indian labor law and social security measure enacted in September 2005 to ensure the “right to work.” This initiative is designed to bolster livelihood security in rural areas by guaranteeing each Household at least 100 days of wage employment annually, with adult members opting to engage in unskilled labor. From April 1, 2008, NREGA expanded nationwide, becoming the world’s largest and most ambitious social security and public works program. Alongside providing employment, the scheme aims to foster the creation of lasting infrastructure such as roads, canals, ponds, and wells, ensuring that work opportunities are available within 5 kilometers of an applicant’s residence and that minimum wages are duly compensated.
How Does the NREGA Scheme Benefit Poor People?
Applicants are entitled to unemployment benefits if work is not provided within 15 days of applying. This ensures that eligible individuals are compensated accordingly in the absence of employment opportunities provided by the government. Therefore, the right to employment under the NREGA Scheme is legally guaranteed. The implementation of MGNREGA primarily rests with gram panchayats (GPs), with the participation of contractors strictly prohibited.
In addition to ensuring economic security and creating rural infrastructure, NREGA plays a pivotal role in environmental conservation, empowering rural women, curbing rural-urban migration, and promoting social equity. The legislation incorporates numerous safeguards to enhance its efficient management and implementation. It delineates fundamental principles, responsible agencies, approved project types, funding mechanisms, monitoring and evaluation protocols, and comprehensive measures to uphold transparency and accountability.
